All items are SOLD "AS IS, WHERE IS" ALL SALES ARE FINAL WITH NO WARRANTIES EXPRESSED OR IMPLIED.

ALL WON ITEMS MUST BE PICKED UP ON THE DAYS SET ASIDE FOR PICKUP. IF NOT PICKED UP BY THE LAST OF TWO PICKUP DAYS THE ITEMS ARE FORFIETED WITHOUT REFUND. YOU MAY SEND SOMEONE IN YOUR PLACE WITH A COPY OF A PAID INVOICE.

Your internet connection/speed is the most important thing to consider when bidding. If you plan on placing bids at the last moment Lexington Online Auction cannot be held liable for you missing a bid due to internet issues on your part or ours so don't wait to bid!

 

Bids cannot be retracted unless you have entered a wrong amount. This change must be done before the end of auction with enough time ALSO to make the change before the item closes by texting 859-230-9848. 

At Lexington Online Auction we do our best to describe every item as accurately and honest as possible. But we may overlook something occasionally.

Bidders, Consignees and Lexington Online Auction agree that the terms and conditions set forth below shall govern this online auction. Lexington Online Auction, its owners, agents and other representatives, are not responsible for any information that is provided in connection with this online auction sale that are misunderstood.

Lexington Online Auction and it's auctioneers and agents will not deal with sellers that have been determined to be misleading or use gray area sales tactics . Lexington Online Auction does not warrant or will we as auctioneers, agents take responsibility for the actions of the sellers but we will do our part in rectifying the issue if one were to occur.

Bidding eligibility: Bidders over the age of 18 and must have a valid Credit Card to put on file prior to bidding.. We can sell to a business entity if you are the approved bidder for that entity and we can verify that bidder Information. All information provided by you the bidder should be current at the time of the sale. If at any time your information has changed, you would need to update this information asap.

Lexington Online Auction cannot be held liable for wrong information in our system that you have provided that may keep us from contacting you as the winning bidder to complete the transaction. Any bidder that has won an item has entered into a binding contract with Lexington Online Auction and the seller of the item. The agreement of these terms and conditions are a binding contract and unless there is due reason either by the seller or buyer to void the contract you will be banned from bidding on future auctions conducted by Lexington Online Auction.

Privacy Policy: You must submit personal information at the time of registration to bid on this auction site. We will never give or sell your information to any outside company. The information you provide us with will only be used by Lexington Online Auction and the owner/seller that you purchase items from, to maintain records for the auction sales and to aid us in providing service to you. This online auction site contains links to other sites we deem "friends of Lexington Online Auction" . We are not responsible for the privacy practices or the content of other websites. Bidding on our Online Auction site: Bidding is done online and you must monitor your bid to see where you stand during the auction start and end time frame. You can enter a max bid and the system will bid for you up to your max bid but will not bid over the amount you have input. At the end of the auction you should be online or increase your max bid when outbid or enter a new max bid. You, as a bidder, understand and agree to how the maximum bid feature works if you choose to use it. You may or may not automatically receive notification if another bidder outbids your maximum bid so it's up to you to keep up with the bid on the items you have bid on.

As a bidder: by agreeing to the terms and placing a bid you are entering a binding contract. You are responsible for any bids placed by you or a designated representative under your bidding ID and password. The security of your bidder information is your sole responsibility and the bidder will be responsible for any and all bids placed under the assigned number. If, at any time, you feel that your bidder number and password have been compromised you must notify us immediately. Auctioneer is the one and only judge regarding the determination of winning bidders, and the single deciding authority if disputes should arise, and accepts no liability for any errors or omissions.  Despite efforts to avoid the withdrawal of lots from the online auction sale after they are listed, it may sometimes be necessary to so withdraw lots, therefore, the owner/seller reserves the right to do so at any time before or during the online auction sale.

Bid Retractions:  When a bid is made you manifest your intent and ability to buy the lot at the bid price. A false or fraudulent bid will result in legal action. Any winning bidder who refuses to purchase the lot will be banned from all future online auctions. The owner/seller reserves the right to accept or reject any or all bids unless otherwise stated.

Payment of won item: Acceptable forms of payment are Visa or Mastercard. All bids are in US Dollars; all settlements will be paid in US Dollars. Pickup or transportation of won item: The buyer, Item(s) won via auction must be picked up within 2 days max from auction close or is considered abandoned and becomes property of Lexington Online Auction to with as they please. If you have questions regarding transportation, contact the owner/seller or Lexington Online Auction before placing any bids. Limit of Liability: In no event shall the auctioneer be liable for lost profits or any special, incidental, or consequential damages whatsoever arising out of or in connection with any sale or transaction. Lexington Online Auction reserves the right to postpone or cancel a sale without notice, if it is determined that such action is appropriate for whatever reason in our sole discretion. Lexington Online Auction or our agents will neither have liability nor obligation to the intended bidders as a result of any withdrawal, cancellation, or postponement of any sale.
